CONDITIONS OF SALE

Cash with order or prior to shipment qualifies for a two (2%) discount. With established credit: 2% 10 days, net 30 days. The 2% 10 days discount applies only when all previous charges have been paid. Past due accounts will be assessed a service charge calculated by a periodic rate of 2% per month, which is an annual rate of 24%, applied to the previous balance after deduction of current payments and/or credits appearing on the statement. Accounts are OVERDUE if not paid within 30 days of invoice date.

DISCLAIMER:
We warrant, to the amount of the purchase price, that plants sold are as represented within recognized nursery tolerances. We shall not be liable for losses due to strikes, delays of carriers, fires, or any other causes beyond our control. Complaints of any type must be made to us in writing within 10 days.

FREIGHT CHARGES: Freight charges are due immediately upon receipt of invoices. 

CONNECTICUT SALES TAX:
We are required under The Connecticut Sales and Use Tax Act to collect a 6% tax on all gross sales from The Robert Baker Company made in Connecticut unless presented with proper exempt information. We are required by law to presume all sales are taxable unless exempt
status is established. If you have any questions concerning the Connecticut Sales & Use Tax Act, please call your Division of Taxation Office. Out-of-State customers are exempt from sales tax providing a tax exempt form is on file, unless merchandise is picked-up or delivered in Connecticut. The Connecticut Sales Tax Bureau will supply Connecticut exempt certificate application forms and instructions for out-of-state customers upon request.

NEW JERSEY SALES TAX:
We are required under The New Jersey Sales and Use Tax Act to collect a 6% tax on all gross sales from Medford Nursery made in New Jersey unless presented with proper exempt information. We are required by law to presume all sales are taxable unless exempt status is established. If you have any questions concerning the New Jersey Sales & Use Tax Act, please call your Division of Taxation Office. 

Out-of-State customers are exempt from sales tax providing a tax exempt form is on file, unless merchandise is picked-up or delivered in New Jersey. The New Jersey Sales Tax Bureau will supply New Jersey exempt certificate application forms and instructions for out-of-state customers upon request.

PAYMENT OPTIONS

1. ESTABLISH CREDIT
When ordering or re-ordering, we can serve you best if you establish credit with us in advance. Please fill out a credit application and provide us with names and addresses of three major suppliers and your bank. A Credit Clearance Form will be furnished upon request. Several weeks are necessary for us to check credit and inform you of our findings.

2. We accept Visa, MasterCard or American  Express as payment.
A credit card payment will not qualify for a cash discount. All other discounts will apply.

3. All customers without credit will be required to pay by credit card or cash.

PICK-UP ORDERS:
All orders for pick-up must be in our possession at least 48 hours in advance of your arrival. It is essential that you arrive for pick-up as scheduled.

MINIMUM PURCHASE:
Container Grown Material - 10 of each size and variety
Container Grown Fruit Trees - 5 of each size and variety
B&B Grown Material - 10 of each size and variety
Minimum Shipment: $1500
Minimum Pick-up: $500

We reserve the right to substitute one size larger or one size smaller container material.
Customers will be notified of any changes.

All materials remaining on order after 5/15 will revert back to open inventory 
for open sales unless delivery or pick-up has been scheduled.
